OU facing lawsuit that could halt football stadium construction

21 October 2015

The renovation and expansion project at the University of Oklahoma’s Gaylord Family — Oklahoma Memorial Stadium could come to a halt temporarily if a Cleveland County judge grants a motion for temporary injunction.

The lowest bidder for the project, HME, is claiming OU and general contractor Flintco awarded the bid to W&W Steel and violated Oklahoma’s Public Competitive Bidding Act, court records show. If the motion is granted, the university, Flintco and W&W could be immediately restrained from proceeding with the performance of the contract.

A petition filed Oct. 5 by HME, a Kansas-based company that does metal fabrication and structural steel work, shows they were the lowest bidder for the overall project. However, the day after the bid opening, Aug. 21, Flintco contacted HME and said they intended to remove a portion of the project that included the erection of pre-fabricated concrete panels.
